Terms and Conditions

1. Agreement

By placing an order with 3D Services USA ("we," "us," "Company"), you ("Customer," "you") agree to these terms. If you are ordering on behalf of a company, you confirm you have authority to bind that company. These terms apply to all orders, quotes, and services provided through 3dservicesusa.com and any related communication channels.

2. Quotes and Pricing

  • Quotes generated through our instant quoting tool are estimates based on the geometry, material, and options you select. Final pricing may differ if we identify issues during design review (e.g., unsupported overhangs, wall thickness violations, or non-manifold geometry).
  • Quotes are valid for 30 days from the date of issuance unless stated otherwise.
  • We reserve the right to adjust pricing if raw material costs change significantly between the quote date and production start. If we need to adjust, we will notify you before proceeding.
  • All prices are in US Dollars (USD) and do not include shipping or applicable sales tax unless explicitly stated.

3. Orders and Payment

  • An order is confirmed when we receive full payment (credit card) or when we approve your invoice request (net-30 terms for qualified accounts). We will send you an order confirmation email.
  • We accept Visa, Mastercard, American Express, and Discover. For orders over $500, we offer net-30 invoice terms subject to credit approval.
  • Production does not begin until payment is received or invoice terms are approved.
  • If your payment is declined or an invoice becomes overdue by more than 30 days, we reserve the right to cancel the order and charge a 1.5% monthly late fee on the outstanding balance.
  • Sales tax is calculated based on your shipping destination and applicable state/local tax rates. We collect and remit sales tax where we have nexus.

4. File Upload and Intellectual Property

  • You retain full ownership of any CAD files, designs, and intellectual property you upload to our platform. We do not claim any rights to your designs.
  • By uploading files, you grant us a limited, non-exclusive license to use those files solely for the purpose of quoting, manufacturing, quality inspection, and fulfilling your order. This license ends when your files are deleted.
  • We will not share your files with other customers, publish them, or use them for any purpose beyond fulfilling your order without your written consent.
  • You represent that you own the rights to the designs you upload, or that you have authorization from the rights holder. We are not responsible for verifying IP ownership and will not manufacture parts that you do not have the right to produce.
  • We reserve the right to refuse any order if we believe the design infringes third-party IP, violates export control regulations (ITAR/EAR), or is intended for illegal purposes.

5. Manufacturing and Quality

  • We manufacture parts using FDM and SLA 3D printing technologies. Parts are produced per the specifications you select (material, layer height, infill, finish).
  • Standard dimensional tolerance is +/- 0.2mm for FDM and +/- 0.1mm for SLA, unless tighter tolerances are agreed upon in writing.
  • 3D printed parts may exhibit visible layer lines, minor surface imperfections, or support marks. These are inherent to the technology and are not considered defects unless they exceed the stated tolerances.
  • Color may vary slightly between batches due to filament/resin lot variations. If exact color matching is critical, let us know before ordering.
  • We perform visual and dimensional quality checks on all orders before shipping. If you require specific inspection reports (CMM, calipers, etc.), request them at the time of ordering.
  • Design-for-Manufacturability (DFM) reviews are advisory only. Any comments, suggestions, or automated feedback we provide about your geometry, orientation, wall thickness, tolerances, or material choice are offered as a courtesy and do not constitute engineering services, certification, or a warranty that the part will be fit for a particular purpose. You remain solely responsible for design correctness, material selection, and validation of the part in its intended end-use environment. Proceeding with an order after a DFM comment is your affirmative acceptance of the associated risk.
  • Material properties are nominal and lot-dependent. Published values for tensile strength, heat deflection, elongation, moisture absorption, UV stability, and other physical properties are manufacturer typicals and may vary batch-to-batch. 3D-printed parts are typically anisotropic: strength along the Z-axis is lower than X/Y. We do not guarantee any specific mechanical or thermal performance unless we have issued a signed written specification for your order.

6. Lead Times

  • Standard production: 2–5 business days from order confirmation.
  • Rush production: 1–2 business days (rush surcharge applies).
  • Lead times do not include shipping transit time. Actual delivery dates depend on the shipping method you select.
  • We will notify you if we anticipate a delay beyond the estimated lead time. If the delay is caused by us, you may cancel for a full refund.
  • Lead times for large or complex orders may be longer. We will confirm the timeline before production starts.

7. Acceptable Use

You agree not to use our services to:

  • Manufacture weapons, weapon components, or items regulated under federal or state law.
  • Produce counterfeit goods or items that infringe IP.
  • Create parts that violate ITAR, EAR, or other export control regulations without proper licensing.
  • Upload malicious files or attempt to exploit our systems.
  • Abuse our quoting system (e.g., automated scraping, excessive quote requests without intent to order).

We reserve the right to refuse service to anyone for any reason, and to cancel orders that violate these terms.

8. Limitation of Liability

To the maximum extent permitted by law, 3D Services USA's total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, production downtime, or costs of substitute goods.

End-Use Restrictions and Product Liability Disclaimer. 3D printed parts are NOT certified and MUST NOT be used in: (a) life-safety systems; (b) medical implants or devices in direct patient contact; (c) aerospace, aviation, or spaceflight critical components; (d) firearms, firearm components, or ammunition; (e) load-bearing structural members; (f) pressure vessels, fluid containment for flammable or hazardous media, food-contact applications, or children's products subject to CPSIA; or (g) any application where failure of the part could reasonably be expected to cause personal injury, death, or significant property damage, unless we have provided a signed, written certification for that specific order.

You represent that you have independently evaluated the part in its intended end-use environment and have not relied on any statement by 3D Services USA regarding fitness, safety, or regulatory suitability. To the maximum extent permitted by law, you release 3D Services USA and its employees, officers, and affiliates from any claim for personal injury, wrongful death, or property damage arising from use or misuse of the parts we produce, including claims based on strict product liability, negligence, breach of implied warranty, or failure to warn. Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement are DISCLAIMED to the maximum extent permitted by law. Some jurisdictions do not allow the exclusion of certain implied warranties; in those jurisdictions our liability is limited to the minimum permitted by law.

9. Warranty

We warrant that parts will be manufactured according to the specifications in your accepted quote. If a part does not meet the stated tolerances or has a material defect, we will reprint it at no charge or issue a refund. Claims must be filed within 14 days of delivery. This warranty does not cover damage caused by mishandling after delivery, modifications, exposure to conditions beyond the material's rated limits, or normal wear and tear.

10. Dispute Resolution

These terms are governed by the laws of the State of Florida without regard to conflict of law provisions. Any disputes will first be addressed through good-faith negotiation. If we cannot resolve the issue within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association (AAA) in Broward County (Fort Lauderdale), Florida. Small claims court actions are exempt from this arbitration requirement.

Class Action and Jury Trial Waiver. To the maximum extent permitted by law, you and 3D Services USA each waive any right to (i) a trial by jury and (ii) participate in a class action, collective action, consolidated action, or representative proceeding. Disputes must be brought in your or our individual capacity, not as a plaintiff or class member in any purported class or representative proceeding. If a court or arbitrator determines the class-action waiver is unenforceable, the remainder of this Section 10 remains in effect and the class claim shall proceed in a court of competent jurisdiction in Broward County, Florida.

Fees and Costs. Each party bears its own attorneys' fees and costs, except that in any action to enforce these terms or collect an overdue balance, the prevailing party is entitled to recover reasonable attorneys' fees, filing fees, arbitration fees, and collection costs.

Statute of Limitations. Any claim arising out of or relating to these terms or your use of our services must be filed within one (1) year after the claim accrues, or it is permanently barred.

11. Indemnification

You agree to indemnify and hold 3D Services USA harmless from any claims, damages, or expenses (including attorney fees) arising from your use of our services, your uploaded designs, or your violation of these terms.

12. Force Majeure

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, supply chain disruptions, pandemics, government actions, power outages, or carrier delays.

13. Modifications

We may update these terms at any time. Changes take effect when posted on this page. Continued use of our services after changes constitutes acceptance. We will notify registered users of material changes by email.

14. Data Security and Breach Notification

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect your account data and uploaded files, including TLS 1.2+ in transit, AES-256 encryption at rest for files in AWS S3, salted and hashed passwords (bcrypt), role-based access controls, audit logging of admin actions, and periodic access reviews. No system is perfectly secure, and we do not warrant that unauthorized access will never occur.

If we confirm a personal data breach affecting your information, we will notify affected account holders without undue delay (and, where EU/UK GDPR applies, within 72 hours of becoming aware of the breach where feasible under Art. 33 GDPR) by email to the address on file. The notice will cover the nature of the breach, likely consequences, and mitigation steps we have taken or recommend you take. Our obligation to notify does not create any additional liability beyond the limits in Section 8.

15. Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full force.
